With nine votes for and two against the Supreme Court's Office confirmed the trend and backed the 31 states are obliged to officially recognize gay marriages that take place in the Federal District.
The endorsement of the Court does not oblige states to change its law, but whether to officially recognize the marital status of same-sex couples to marry in the nation's capital.
On Tuesday, ministers Margarita Luna Ramos and Jose de Jesus Gudino Pelayo supported the project from its counterpart Sergio A. Valls Hernández, which added new votes to be valid acts of civil registration in Mexico City.
Valls Hernández said he was surprised by the controversy generated by the subject and the lack of support for his project, by the Chief Justice, William I. Mayagoitia Ortiz and Minister Sergio Salvador Aguirre Anguiano, it mentioned that there is forcing states to legislate sobre el tema.
“El artículo 121 no somete a los estados, nunca dice que los actos civiles de una entidad deban estar ajustados a las otras entidades, o que sean lineales”, expresó Valls, quien agregó que dicho precepto no excluye al Distrito Federal.
“El hecho de que 31 entidades definan el matrimonio de manera distinta no pueden en forma alguna limitar la facultad normativa del Distrito Federal”, añadió.
El lunes pasado, los ministros José Ramón Cossío Díaz, Fernando Franco González Salas, Arturo Zaldívar Lelo de Larrea, Luis María Aguilar Morales, Olga Sánchez Cordero y Juan N. Silva Meza apoyaron la postura del ministro designer.
